The Bidder MUST agree to these Terms and Conditions prior to the award of items from any PRC Auction Bidder acknowledges and agrees that he or she is obligated to purchase the equipment as described in the respective auction hosted by PRC on behalf of the Seller. By bidding on an item Bidder agrees to be bound by the conditions of sale set forth herein and in the Auction Announcement. Bidder also acknowledges and agrees that upon submission to PRC, it may not withdraw any bid.
Line Item Auctions are lists of equipment that require an individual bid for each piece of equipment in the lot. The Bidder is not required to bid on every piece of equipment in the lot. Bidder understands that it may not be the successful bidder for all line items or pieces for which a bid has been submitted. Further, submitted bids shall not be contingent upon being awarded any other piece of equipment and the Bidder agrees to accept and pay the winning bid amount for all individual line items and pieces awarded to the Bidder by PRC.
Lot auctions will be comprised of multiple items per auction. One bid for all items is required any other bid will not be accepted.
PRC Auctions may charge a buyer's premium on an item (in line item auctions) or on a lot (in lot auctions). This premium will be added to the closing or "hammer" price of the item or auction. For example, if you bid on and win an item for $100 with a 15% buyers premium, the total price of the item (minus any applicable taxes) would be $115 ($100 bid + $15 for 15% buyer's premium).
PRC Auctions has the right to retract any item from any auction for any reason. This can happen at any time, up to and including just before the item is shipped out of the facility. Though it is our practice to commit to selling all items up for auction, we stand behind our products and may happen to see some things that we do not find acceptable, and thus will not sell those items.
Any excise, sales, use, transfer, value added or similar tax required to be made to any governmental entity in connection with the sale of the Equipment shall be paid one hundred percent (100%) by the buyer.
Successful bids will be posted in the Completed Bids section of the registered Bidder's Bid Status form. Bidder understands that this bid is an offer to purchase, which if accepted by PRC, will become a binding contract to purchase all awarded equipment. PRC's acceptance of the offer will be evidenced by the winning listing in the Completed Bids section of the Bid Status page. Equipment can not be shipped or picked up until payment has been received and cleared. PRC must receive Bidder's payment within five (5) days of the auction end date, by certified check, cashiers check, money order or wire transfer, for all awarded equipment per auction. Wire transfers will be accepted for payments over $500. We also accept Mastercard and Visa. All successful bidders auctions that end with less than 10 item(s) weighing a total of 70 pounds or less will be shipped via UPS and charged the cost of the UPS fee plus the below packaging fee for the appropriate size box. PRC will make a best effort to combine awarded items into same box to reduce shipping costs. Upon request PRC will arrange for packaging and/or shipping larger items at the Bidder's expense. Larger shipments will be billed to the Bidder at cost plus 25% for transportation and the below packaging fees will apply. Palletizing and crating services are available and will be quoted on a case-by-case basis. If Bidder elects to arrange for transportation such arrangements must be made within 10 days of the auction end date. Requests to extend the 10 days shipping window must be made in writing within 7 days of the auction end date and storage fees of $25 per week for a (4'wide x 4'deep x 5'high) pallet space will apply. Failure to comply with the shipping requirements will result in a null auction and PRC will have the option grant an extension or return any payment and post the equipment up for sale. The risk of loss of the equipment covered by this agreement shall pass to Bidder after PRC makes delivery of same to a common carrier arranged by PRC or the Bidder.

BIDDER EXPRESSLY UNDERSTANDS AND AGREES THAT PRC SHALL IN NO WAY BE DEEMED OR HELD TO BE OBLIGATED, LIABLE OR ACCOUNTABLE UPON OR UNDER ANY GUARANTIES OR WARRANTIES, EXPRESS OR IMPLIED, STATUTORY, OR BY OPERATION OF LAW (INCLUDING NO WARRANTY OF MERCHANTABILITY OR OF FITNESS). ALL GOODS DELIVERED TO THE BUYER UNDER THIS AGREEMENT ARE SOLD "AS IS" WITH NO WARRANTY, RETURN OR REFUNDS UNLESS OTHERWISE SPECIFIED.
For any equipment specifically guaranteed in the Bid Announcement to be in working condition upon receipt by the undersigned and unless otherwise noted on the Bid Announcement, the undersigned will have seven (7) calendar days after receiving the equipment to inspect said equipment to determine that it is in working condition upon receipt. If any equipment is not in working condition upon receipt or if any equipment is not the equipment as described in the Bid Announcement, the undersigned must notify The Product Resale Company within the 7-day inspection period and The Product Resale Company will issue an RMA# and provide return shipment information.
All equipment returned pursuant to the Inspection Period above, at The Product Resale Company option, will either be repaired, replaced with an equal or greater unit, or a refund will be issued. The Product Resale Company shall not be liable for any damages, either direct or consequential, as a result of equipment returned to The Product Resale Company pursuant to this provision.
Notwithstanding the Inspection Period above, no sale shall be invalidated by reason of any fault in any lot or by reason of any lot being incorrectly described in the Bid Announcement, and no compensation shall be paid for any such fault or error of description.
Bidder acknowledges and agrees that PRC is an auctioneer acting on behalf of the Seller to sell the equipment described in the Auction Announcement. PRC is not the owner of, nor does it have good and marketable title to, the equipment described in the Auction Announcement and makes no representations to Bidder as to the quality of the equipment or the truth or accuracy of the Bid Announcement and/or the PRC Auctions site. Because PRC is an auctioneer, the Bidder acknowledges and agrees that any dispute arising out of or in any way connected to the awarded equipment or this transaction shall be between Bidder and Seller and hereby unconditionally releases PRC from any and all claims, causes of action, demands and damages (actual and consequential) of every kind and nature, known and unknown, resulting from this agreement.
Bidder agrees to indemnify and save and hold harmless and to defend, at its sole cost and expense, PRC and Seller from and against any and all claims, liens, loss, liability, judgments and other enforceable rulings and executions asserted or imposed upon PRC and/or Seller resulting from, relating to or arising out of the handling, use, operation and disposition of the equipment purchased by Bidder after delivery of said equipment to Bidder.
Upon shipment, the Buyer agrees to assume ownership, possession, title, and control of the materials purchased. The Buyer understands that computer and electronic equipment or components thereof may contain hazardous materials such as, lead, mercury, cadmium, mercury, PCB’s or toxic contaminants that will contaminate the environment if disposed of improperly. The Buyer agrees to process, recycle, resell, displace or dispose of all products transferred from Seller to Buyer in an environmentally correct manner that is in accordance with all local, state, federal, and international laws and regulations. Buyer assumes risks of loss, and all other incidents of ownership for any materials or equipment purchased by Buyer from Seller, and will indemnify and hold harmless Seller and/or original owner of the equipment of any liabilities resulting from the resale, disposition or disposal of the materials purchased.
If the Bidder defaults in any of the above conditions, the lot so purchased may, if PRC sees fit, be posted up again and resold. The deficiency, if any, arising upon such resale, together with the expenses thereof, shall be made good by the Buyer in default of this sale.
